Abstract: A 9 page paper discussing the history of tort law and whether there is any value in it. The paper attempts to remain positive about tort law in general, but it is so routinely perverted that remaining positive is difficult. The point is that tort law has its place, but it is continually perverted so that it is less effective than it could be. Nagareda (1998) notes that the difficulty lies in not separating corporate misconduct cases into either civil or criminal matters. That place where it is most effective likely is product liability.
